I run an online store www.orientsun.sk

When we sell goods and operate our website, we process some personal data.

By giving your consent to the processing of personal data on the  www.orientsun.sk portal  , you are giving your consent by giving your consent in a serious and voluntary, specific, informed and unambiguous manner to the data subject (buyer) in the form of an unequivocal affirmative action within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 December 2016/679.  April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as in accordance with the provisions of Act No. 18/2018 Coll. of 29 November 2017 on the Protection of Personal Data and amending certain laws with subsequent amendments on the Controller (hereinafter referred to as the "GDPR and the Act").

 

2 PURPOSE OF PROCESSING PERSONAL DATA

If you have provided us with PDA data, it will be used for the following purposes:

2.1 Online Store – to conclude and perform a Sales Agreement, make a payment, deliver a Product or carry out other related activities (e.g. complaints and other obligations related to consumer protection regulations) concluded within the framework of a www.remab.sk between the Operator and the Buyer. In order to process your order, you have provided us with your name, address, email address, telephone number and payment details. Email and telephone contact also serves as a means of communication.

We will continue to process personal data in order to fulfil our obligations under generally applicable law (mainly for accounting and tax purposes or to investigate complaints)

Information such as the order confirmation and up-to-date information about the status of your order will be sent to your email address.

We process personal data on the legal basis (Art. 6 para. 1 lit. b GDPR and the Act), the processing of personal data is necessary for the performance of a contract to which the data subject (Buyer) is a party or for the implementation of a pre-contractual measure on the basis of the request of the data subject (Buyer) (Art. 1 (1) lit. a) GDPR). 2. 1), i.e. it is a contractual requirement.

2.2 Marketing – for marketing purposes, if you have given the consent of the Controller by clicking on opt-in. Marketing goals include sales promotion, marketing offers, newsletters, product information, and news. Marketing information can only be sent to registered customers. If you do not want to receive these offers, just write to us on info@orientsun.sk  and we will unsubscribe or remove them from the newsletter.

3 REGISTRATION

The buyer can register on www.orientsun.sk

We process your personal data in the following ways:

You protect your account with a password. When you log in to your account, you will receive information about your orders, you can edit your XP and your preferences for sending newsletters. Protect your password, the operator is not responsible for misuse of your password.

However, if you have changed your mind and no longer wish to register, please contact us at info@orientsun.sk  and we will delete your registration immediately.

4 THIRD PARTIES

Your personal data may be shared with third parties.

Other recipients of your personal data are Shoptet (operator of the e-shop system), GLS (parcel service), TOPTRANS (parcel service), Packeta (parcel service), Slovenská pošta (parcel service), and the Buyer's personal data will be processed only for the purpose of performing the contract and for the period of time required in paragraph 6. Processing period.

 

5 UNDER 16 YEARS OLD

In connection with the provision of information society services, the Controller processes personal data on the basis of the consent of the data subject in accordance with the law, if the data subject is at least 16 years old. This online store is not directly intended for persons under the age of 16.

The operator does not process DO from anyone under the age of 16. With each registration/login, the operator asks the buyer for an affidavit. This online store is not intended for purchases by children under the age of 16.

6 DURATION OF PROCESSING

The Buyer consents to the processing of personal data from the date of consent in accordance with these Terms and Conditions for a period of up to 10 years, if the purpose of performance of the Agreement is achieved (this applies to accounting documents – invoices).

7 AUTOMATED SUBMISSION

In order to improve the quality of marketing campaigns, the operator uses automated profiling. Through profiling, we segment the offers that could be interesting and more advantageous for you. We use the following Google Adwords systems for profiling.

No consent is required for the basic collection of statistical data, e.g. via the Google Analytics tracking code.

8 IP ADDRESS

It is a series of numbers that uniquely identify a device on a computer network.

From a data protection perspective, an IP address can be defined as data that relates to an identifiable person.

An IP address becomes personal data when:

An IP address is personal data when it is processed by an ISP together with another identification (name, email address...).

Static IP addresses used by individuals should be treated as personal data.

A dynamic IP address is considered personal data if, together with the dynamic IP address, the provider of the online service processes other identifiers that are considered personal data (e.g. first name, last name, e-mail address, etc.).

If the IP address is stored on the website (e.g. the content management system Prestashop for comments), it is necessary to select an appropriate processing purpose or to use pseudonymization.

SECURE DATA TRANSFER

Your personal data is transmitted securely through encryption. The SSL (Secure Socket Layer) encryption system is most commonly used for secure communication with web servers. Personal data in our systems and on the website are protected against loss, destruction, alteration and further dissemination of data by unauthorised persons by appropriate technical and organisational measures.

When you use our www.orientsun.sk website, only you have access to your account, so make sure you keep this information confidential. The Operator is not responsible for the unauthorized handling of the password or its misuse.

9 RIGHTS OF THE DATA SUBJECT (Buyer)

According to the GDPR, you have the right to: (i) the right to rectification, (ii) the right to erasure, (iii) the right to data portability, (iv) the right to object, (v) the right to withdraw consent, (vi) the right to access.

The right to rectification.

The Buyer has the right to demand that the Operator immediately correct the defective GARDENS concerning him and add incomplete GARDENS.

The right to erasure.

The Buyer has the right to demand from the Operator the immediate removal of the intellectual property concerning him. The Controller shall remove these DPAs without undue delay if one of the following grounds applies:

PD is no longer required for the purposes for which it was obtained or processed,

the data subject has withdrawn his/her consent to the processing of PD for at least 1 specific purpose, or the consent is invalid if its provision is precluded by a specific provision,

the data subject objects to the processing of the PD in accordance with the processing of the IP and there are no legitimate grounds for the processing, or the data subject objects to the processing of the PD in the context of direct marketing, including profiling,

AD is unlawfully processed,

the basis for the annulment is the performance of an obligation arising from this Law, a specific provision or an international agreement to which the Slovak Republic is bound, or

PD in connection with the provision of information society services, the requested person is under 16 years of age.

If the controller has published the PD and is required to delete it, it is also required to adopt appropriate security measures, including technical measures related to the technology available and the cost of its implementation, in order to inform other controllers of its request that these controllers make references to their PD and its copies or copies or copies delete.

Right to data portability.

The Buyer has the right to receive the PD concerning him, which he has provided to the Operator, in a structured, commonly used and machine-readable format and has the right to transfer this PD to another Operator, the Seller, if this is technically feasible and if:

The PD is processed on the basis of the consent of the data subject, on the basis of a contract and on the basis of the consent of the data subject, which is invalid if its determination is excluded by a specific provision,

The processing of personal data is automated.

Right to object

The Buyer has the right to object to the processing of personal data concerning him for the purpose of direct marketing, including profiling within the scope of profiling, insofar as it is related to direct marketing, the Controller is obliged to clearly inform the data subject of his rights at the latest at the first contact with him, and the information about this right must be clearly stated and separate from all other information. The Buyer may exercise the right of opposition in an automated manner using the technical specifications.

Withdrawal of consent

The buyer has the right to withdraw consent to the processing of personal data concerning him at any time. The withdrawal of consent does not affect the lawfulness of the processing of personal data based on consent before its withdrawal; The buyer must be informed of this fact before consenting. The buyer can withdraw the consent in the same way as he gave the consent.

Right of access to information.

The Buyer has the right to obtain confirmation from the Controller as to whether the Buyer's PD is being processed. In the event that the Controller processes such intellectual property, the buyer has the right to access such intellectual property and information about:

Purpose of processing PDA,

Category of processed PD – in our case it is regular PD, the administrator does not edit a special category of PD,

an indication of the recipient or category of recipients to whom the PD has been or is to be transmitted, in particular the recipient in a third country or an international organisation, as far as possible;

PD retention period; if this is not possible, information on the criteria for their determination,

the right to request the Administrator to rectify the PD in relation to the Buyer OD, to delete it or to restrict its processing, as well as the right to object to the processing of the PD,

the right to initiate proceedings;

Source of the PDA, if no personal data has been collected from the buyer,

the existence of automated decision-making in individual cases, including profiling, in which case the Controller will provide the Buyer with information in particular about the procedure used, as well as about the significance and expected consequences of such PD processing for the Buyer.

The operator is obliged to provide information within 30 days of receipt of this request. This period may be extended by the operator for another 60 days, about which we will inform you about the postponement.

For the repeated provision of the data requested by the Buyer, the Operator may charge a reasonable fee corresponding to the administrative costs. The Operator is obliged to provide the Buyer's intellectual property in the desired manner or in accordance with the Buyer's wishes.

The operator reserves the right to check the buyer and determine whether it is a specific buyer. Verification consists of providing additional information, e.g. through control questions. Verification is important from the point of view of providing information about the PDA that the Administrator processes in order to protect personal data.

The buyer's right to initiate proceedings.

The Buyer may submit a request to initiate proceedings pursuant to Article 100 of the Law, if his rights directly affect him, the proposal must include the persons submitting it against whom the proposal is directed, together with the subject matter of the proposal, indicating the rights allegedly violated in the processing of personal data, evidence.

The template for the application will be published on the website of the Office for Personal Data Protection, Hraničná 12, 820 02 Bratislava. The authority examines the complaint within 30 days, decides within 90 days or can extend the deadline accordingly.

10 COOKIES

10.1In accordance with Section 55 (5) of Act No. 351/2011 Coll. on Electronic Communications of the Slovak Republic, as amended, we inform you about the use of cookies and draw your attention to the possibility of changing the settings of your web browser if the current settings for the use of cookies do not suit you.

This Policy contains information about how the Administrator uses cookies and similar technologies (hereinafter referred to as "cookies").
